Overview and Acceptance

Welcome to Joy Creations Studio. These Terms and Conditions list the rules and regulations for the use of our website, the purchase of our handmade jewelry, and the booking of our graphic design services. By accessing this website and placing an order, you agree to be bound by these terms.

Throughout the site, "we", "us", and "our" refer to Joy Creation Studio. By visiting our site or purchasing from us, you engage in our "Service" and agree to these Terms of Service. We reserve the right to update these terms at any time.

User Obligations

You must be legal age to use our services. Illegal activities and harmful content transmission are prohibited. You are responsible for maintaining accurate account  information.  

Part A: General Website Terms (Applies to all visitors)

1. Intellectual Property

     Handmade Products & Brand Assets: All physical goods, unique designs, original   artwork, website content, images, and brand assets are the exclusive intellectual property of Joy Creation Studio. The purchase of any handmade product does not transfer any ownership rights, copyright, or reproduction rights to the buyer. You are strictly prohibited from copying, replicating, modifying, or commercially reselling our physical designs or digital content without our prior written consent.

Bespoke Graphic Design Services: Joy Creation Studio retains full ownership and copyright of all initial concepts, working drafts, and final design assets generated during a client project. In accordance with the New Zealand Copyright Act 1994, the statutory "Commissioning Rule" is explicitly excluded from our agreements. Full intellectual property rights and legal ownership of the final approved design will transfer to the client only upon receipt of full and final payment of all outstanding invoices. We reserve the right to display the final designs within our professional portfolio and marketing materials.

2.Third-Party Links & User Submissions

Third-Party Links & User Submissions: Our website may contain links to external websites that are not operated or controlled by Joy Creation Studio. We are not responsible for the content, privacy policies, or practices of any third-party platforms. Additionally, if you submit feedback, suggestions, reviews, or creative ideas to us, you grant us an unrestricted, royalty-free right to use, edit, publish, and distribute that content across our channels without compensation or obligation to you. 

3.Disclaimer & Liability Limits

We do our absolute best to provide an exceptional website experience, but our digital services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Joy Creation Studio will not be liable for any indirect, incidental, or consequential damages arising from your browsing or use of our website.

Part B: Terms of Sale for Handmade Products (Applies to retail buyers) 

4. Consumer Guarantees Act & Fair Trading Act (NZ)

Joy Creation Studio fully complies with the New Zealand Consumer Guarantees Act 1993 (CGA). Our physical products come with guarantees that cannot be excluded under New Zealand consumer law. You are entitled to a remedy for faulty goods as provided under the CGA. If your handmade item is faulty, damaged, or does not match its description, you are entitled to a remedy (repair, replacement, or refund) in strict accordance with your legal rights. Please note that consumer guarantees do not apply if you simply change your mind, cause the damage yourself through misuse, or alter the product.

Business Purchases: If you are purchasing goods from us for business use or trade, you agree that the Consumer Guarantees Act 1993 and sections of the Fair Trading Act 1986 do not apply to these transactions. 

5. Handmade Product Intellectual Property

The purchase of any physical handmade product or original artwork does not transfer any copyright, reproduction rights, or design ownership to the buyer. You are strictly prohibited from copying, replicating, or commercially reselling our physical designs without our express written permission.

6. Products, Handcrafted Variations & Care 

Natural Material Variations: Images of our products on this website are intended to show design examples. Due to the handcrafted nature of our jewellery and natural variations in gemstones, minor differences from product images may occur. Fair wear and tear over time is not considered a manufacturing defect.

We reserve the right to limit quantities, modify prices, and discontinue products without notice. 

Custom-made are finalised upon order confirmation and are non-refundable for change of mind, without limiting your rights under New Zealand consumer law. 

7. Pricing, Payments & Errors

Prices: As Joy Creation Studio is a sole trader operating below the statutory registration threshold, Goods and Services Tax (GST) is not applicable, and no GST will be charged on our products or services. We reserve the right to adjust our pricing at any time without prior notice.

Listed prices can change without notice. However, your price is locked once you checkout or sign a contract.

Payments: We accept major credit cards online. 

Errors: If an item or service is mistakenly listed at the wrong price, we can cancel the order. We will notify you immediately and refund you in full.

8. Production Timelines

Every piece of jewelry from Joy Creations Studio is uniquely handcrafted to order. Please allow approximately 1 to 2 weeks for production before your item is packaged and shipped.

9. Shipping & Delivery Risk

We package all handmade goods securely for transit. Where we arrange delivery to consumers, we ensure that products arrive safely and within a reasonable timeframe in accordance with our obligations under the Consumer Guarantees Act 1993. For business customers, or in the case of major external disruptions completely outside our control (such as severe natural disasters or national industrial action), Joy Creation Studio will not be held liable for delivery delays or failures caused by third-party courier services. 

In the event we are not able to ship to the shipping address you advise, we will notify you, your order will be cancelled, and you will receive a refund in respect of your purchase ( unless you provide an alternate eligible shipping address).

For NZ deliveries, allow approximately two business days for delivery in the North Island and three working days in the South Island. International delivery time varies depending on the country but unusually takes three to ten business days. 

It is the responsibility of the customer to make sure the package is delivered to the correct address and signed for by the customer as it is the customer’s personal custody once it has left Joy Creation Studio premises. Joy Creation Studio is not responsible for delays, additional delivery costs, or failed delivery resulting from incorrect or incomplete information provided by the customer. 

10. Returns

 Please refer to our Returns and Refund Policy for further information. Please note that custom jewellery and custom graphic design services are generally non-refundable once work has commenced, except where a refund or other remedy is required under applicable New Zealand law.

11. International Tax

For international shipments outside New Zealand, any local customs duties or import taxes are the customers responsibility. 

Part C: Terms for Bespoke Graphic Design Services (Applies to design clients)

12. Project Ownership & Copyright Transfer

Joy Creation Studio retains full ownership and copyright of all initial concepts, working drafts, and preliminary design assets generated during a client project. In accordance with the New Zealand Copyright Act 1994, the statutory "Commissioning Rule" is explicitly excluded from all our agreements.

Full intellectual property rights and legal ownership of the final approved design will transfer to you only upon receipt of full and final payment of all outstanding invoices. We reserve the right to display the final designs within our professional portfolio, website, and marketing materials unless a confidentiality agreement is signed beforehand.

13. Project Amendments, Scope, and Revisions

Unless explicitly stated otherwise in your specific project quote, our fixed fees include up to two (2) rounds of revisions based on your original design brief.

  • Definition: A "round of revisions" refers to a compiled list of design adjustments sent to us at one time.

  • Extra Work: Any additional rounds of edits, or changes that deviate significantly from your initial design brief, will be treated as an out-of-scope variation and billed at our standard hourly rate.

  • Feedback Window: To keep projects moving on schedule, you must provide your revision feedback within seven (7) working days of receiving a draft. If no feedback is received within this window, the draft will be deemed accepted as final.

14. Commercial & Business Transactions (Contracting Out)

If you are purchasing goods or acquiring graphic design services from us for business use, trade, or commercial purposes, you agree that the provisions of the New Zealand Consumer Guarantees Act 1993 and sections 9, 12A, and 13 of the Fair Trading Act 1986 do not apply to these transactions. Both parties agree that it is fair and reasonable to be bound by this clause.

15. Quotes, Deposits, and Payment Timelines

All quotes provided are valid for 30 days from the date of issue. For custom graphic design projects, a non-refundable deposit is required before work begins. Final high-resolution design assets will not be released until full and final payment has been processed. Late payments may incur interest charges or a pause on active design work.

Part D: Privacy & Data Governance (Applies to all)

16. Privacy and Data Security

We respect your privacy and safeguard your personal information in accordance with the New Zealand Privacy Act 2020. Any personal data collected during your checkout, account creation, or design consultations (such as names, contact details, shipping addresses, and design briefs) is handled securely and used solely to fulfill your orders. Your data is strictly governed by our full, standalone Privacy Policy, and you retain the legal right to request access to or correction of any personal data we hold about you.

Part E: Legal Framework & Pricing

17. Pricing and Taxes

All prices displayed on our website or provided in custom graphic design quotes are in New Zealand Dollars (NZD). Joy Creation Studio is not currently registered for GST. Accordingly, GST is not charged on our products or services. If our GST registration status changes, pricing and GST treatment may be updated accordingly.

18. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. If a dispute arises between you and Joy Creation Studio in relation to our products or services, both parties agree to first make reasonable efforts to resolve the matter directly and in good faith. 

19. Severability

If any provision, part of a provision, or sentence of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or tribunal, that provision or part of the provision will be severed or limited to the extent necessary.

The remaining provisions of these Terms and Conditions will continue in full force and effect.
